The following terms and conditions apply to all website development / design services provided by Tanja Segal Webdesign to the Client.
It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Please read these terms and conditions carefully. Any purchase or use of my services implies that you have read and accepted the terms and conditions.
2. Material & Licenses
The client agrees to deliver the nessesary material for each page of the website upon beginning the design phase of the website, to assure Tanja Segal Webdesign to provide the quickest service possible to the client.
Material may include: written text for webpages, contact data, photos, pictures or any other material that should be part of the overall webdesign.
Furthermore the client agrees that all material provided has to be licensed for online use. Tanja Segal Webdesign does not account for any lawsuits against a client, for using unlicensed material on the website provided by the client.
Charges for services to be provided by Tanja Segal Webdesign are defined in the project quotation that the Client receives via e-mail. Quotations are valid for a period of 30 days. Tanja Segal Webdesign reserves the right to alter or decline to provide a quotation after expiry of the 30 days.
All website design services require a minimum down payment for 2 hours of Eigthy (80) USD before the work on the website will begin. After that you will receive a weekly invoice on Thursdays with a detailed hourly breakdown, prior to upload to the server or release of materials.
Payment for services is due by PayPal, Credit Card, Bank transfer or Cryptocurrency transactions. Cheques should be made payable to Tanja Segal and sent to Tanja Segal Webdesign, 5298 Elvira Road, Woodland Hills, CA 91364. Bank details will be made available on invoices.
4. Client Review
Tanja Segal Webdesign will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall website development is completed. At the completion of the project, such materials will be deemed to be accepted and approved unless the Client notifies Tanja Segal Webdesign otherwise within five (5) days of the date the materials are made available to the Client.
Invoices will be provided by Tanja Segal Webdesign on a weekly basis every Thursday. Listing an hourly breakdown for work spend on the creation of the clients website. Invoices are normally sent via email; however, the Client may choose to receive hard copy invoices. Invoices are due upon receipt. Accounts that remain unpaid thirty (30) days after the date of the invoice will be assessed a service charge in the amount of $60.00
6. Additional Expenses
Client agrees to reimburse Tanja Segal Webdesign for any additional expenses outside of the hourly labor. Any necessary additional expense like purchase of special fonts, stock photography etc. will be approved in writing by the Client.
7. Design Credit
A link to Tanja Segal Webdesign will appear in either small type or by a small graphic at the bottom of the Client's website. If a graphic is used, it will be designed to fit in with the overall site design. If a client requests that the design credit be removed, a charge of Sixty (60) USD will have to be paid. The Client also agrees that the website developed for the Client may be presented in Tanja Segal Webdesign's portfolio.
8. Access Requirements
The Client's website is to be installed on a third-party server, Tanja Segal Webdesign must be granted temporary read/write access to the Client's storage directories which must be accessible via FTP. Depending on the specific nature of the project, other resources might also need to be configured on the server.
9. Domain Names
You will be responsible for your domain name, account and the hosting of your website.
Tanja Segal Webdesign may purchase domain names on behalf of the Client. Payment and renewal of those domain names is the responsibility of the Client. The loss, cancellation or otherwise of the domain brought about by non or late payment is not the responsibility of Tanja Segal Webdesign. The Client should keep a record of the due dates for payment to ensure that payment is received in good time.
10. Governing Law
This Agreement shall be governed by California's United States Law.
